1. From 21 June 2018, One-Stop Public Office must have camera Installed

The implementation of the one-stop service and inter-agency one-stop service mechanisms in handling the administrative procedures has been specified in Decree No. 61/2018/ND-CP dated 23 April 2018, which shall take effect from 21 June 2018.

Accordingly, One-Stop Public Offices should be equipped with cameras to monitor the whole working area of the One-Stop Public Office with connection to the higher authorities and the whole system; Arrangement for a installation area for automatic queue management system; Touch screen for organizations and individuals to look up information and administrative procedures, look up the results of administrative procedures; Arrangement for sufficient waiting room chairs; etc.

This Decree also specifies prohibited behaviors of officials at One-Stop Public Office. In particular, officials at One-Stop Public Office must not obstruct organizations and individuals in their choice to file, receive and get results of administrative procedures; refuse processing administrative procedures, prolong the time for their settlement or arbitrarily request for further documents and papers not prescribed by the regulations; shift responsibility, be uncooperative, unfair, non-objective when handling administrative procedures, etc.

At the same time, organizations and individuals requesting for administrative procedures must not use tricks to deceive or bribe officials, public servants and civil servants handling administrative procedures; calumniate, file a recommendation, complain, denounce, impersonate another person to make untrue or groundless allegations.

2. Tax refund for goods exempted from trade remedies

On 20 April 2018, the Ministry of Industry and Trade issued Circular No.06/2018/TT-BCT, detailing regulations on trade remedies, which shall take effect on 15 June 2018.

Accordingly, in the case that imported goods are exempted from application of trade remedies, organizations and individuals shall be entitled to tax refund paid for trade remedies for batches of imported goods registered in customs declarations during exemption period stated in the decision on exemption.

Imported goods subject to trade remedies shall be considered for exemption of provisional or official trade remedies including: special products of the similar goods or directly competitive goods domestically made; quantity of the similar goods or directly competitive products domestically made is insufficient to meet the domestic needs; etc.

The information accepted by the investigation agency as confidentiality at the request of the involved parties in the investigations, application of trade remedies include: Business secrets in relation to the property of a product or manufacturing process; Information on production and business activities of the enterprise, including production costs; cost of sales, etc.

3. Criteria for determination of agricultural enterprises that apply high technology (hi-tech)

According to Decision No. 19/2018/QD-TTg dated 19 April 2018 of the Prime Minister, which shall take effect on 5 June 2018, hi-tech agricultural enterprises shall be defined by 4 criteria.

These criteria include:

(a) Applying high technologies in the list of high technologies prioritized for development investment;

(b) Creating agricultural products of high quality, productivity, value and efficiency; and the turnover from agricultural products applying high technologies accounts for at least 60% of the total annual revenue;

(c) Conducting studies, trials of high technology application, transferring high technologies to produce agricultural products; the total expenditure on research activities is at least 0.5%; the total employees who are directly engaged in research and have university or higher degree account for at least 2.5% of the workforce;

(d) Applying environment-friendly and energy-saving measures in the production and quality control of agricultural products to meet Vietnamese standards, technical regulations or international standards.

According to this Decision, certificate of hi-tech agricultural enterprise shall be valid for 5 years from its date of issuance. Within 45 days from the expiry date of the certificate, enterprises may apply for re-grant.

4. Three subjects enjoying agricultural insurance support

This is the content of Decree No. 58/2018/ND-CP dated 18 April 2018, on agricultural insurance, which shall take effect on 5 June 2018. Particularly, the subjects enjoying agricultural insurance support include:

(a) Crops: Rice, rubber, pepper, cashew, coffee, fruits trees, vegetables;

(b) Livestock: buffaloes, cows, pigs and poultry;

(c) Aquaculture: Black tiger shrimp, white leg shrimp, shark catfish. Individuals directly engaged in agricultural production of households of poverty or near poverty shall be supported a maximum of 90% of agricultural insurance premiums; those who are not of households of poverty or near poverty poor shall be supported 20% of agricultural insurance premiums.

 In addition, agricultural production organizations following the production model of cooperation, connection, concentration, large scale with application of science and technology and advanced production process into their production, towards clean, hi-tech, environment friendly agriculture will be supported 20% of agricultural insurance premiums.

 Risks under insurance support include: risks of natural disasters; risks of plant diseases and pests.

5. Remove 62 business conditions in the field of culture, sports and tourism

The proposed plan for reduction and simplification of business investment conditions under the State management of the Ministry of Culture, Sports and Tourism is approved under Decision No. 1396/QD-BVHTTDL dated 18 April 2018.

According to the proposed plan for reduction and simplification of 62/118 business investment conditions, of which 20 are simplified and 42 are abolished.

It is worthy of note that the Ministry proposes to abolish the conditions in business of karaoke service: location of karaoke business in residential areas must be approved by adjacent households, 200 meters or more away from schools, hospitals, religious or belief institutions, historical-cultural sites or the State administrative units; the door of the karaoke room must be a colorless glass door so that the whole room can be visible from the outside; etc.

In business of video games, the conditions that the video game shops must be 200 meters or more away from primary, secondary and high schools and ensure traffic order and safety are removed.

This Decision takes effect from the date of signing.

6. Exemption from fee of land use for enterprises investing in agriculture

To encourage enterprises to invest in agriculture and rural area, on 17 April 2018, the Government issued Decree No. 57/2018/ND-CP, providing many preferential policies for these enterprises.

Exemption from and reduction of land use fees

Enterprises having agricultural projects shall be exempted from fee of conversion of land use purpose for the land area used to construct residential houses for employees working for the projects; such land area shall be exempted from fee of land use after the purpose of land use is converted.

For enterprises having agricultural projects with special investment incentives, such projects shall be exempted from land rent or water surface rent as from the date on which the State leases land or water surface to them; having agricultural projects with investment incentives, such project shall be exempted from land rent or water surface rent for the first 15 years; etc.

Credit access and support

Enterprises having investment projects in agriculture and rural area are supported by the local budgets for commercial loans after the projects are completed. The level of support will be equal to the difference between the commercial loan interest rate and the State credit interest rate for investment incentives, calculated on the actual debt balance at the time when the credit support dossiers are reviewed.

Loan limit for interest rate support will be up to 70% of the total investment of the project; the maximum period of support is 8 years.

Support for training human resources

Enterprises having agricultural projects with special investment incentives, investment incentives and encouraged to directly invest in vocational training for their employees shall be supported by the State budget at the level of VND 2 million/month/employess, the period of support is 3 months.

At the same time, these enterprises are supported with 50% of their expenses for advertising and brand building the national and provincial key products; 50% of expenditure for participating in domestic and foreign trade fairs approved by the competent authorities.

Investment support for breeding facilities of dairy or beef cattle Enterprises having projects on investment in breeding facilities of dairy and beef cattle supported by the State budget VND 5 billion/project to build infrastructure for waste treatment, transportation, electricity and water supply, barn, and equipment purchase.

Enterprises importing cattle or high-yielding breeds for direct raising or cooperation with the households shall get additional support of VND 10 million/cow.

This Decree took effect on the date of signing.

7. 384 business conditions removed by Ministry of Transport

On 17 April 2018, the Ministry of Transport issued Decision No.767/QD-BGTVT, announcing the plan to reduce and simplify regulations on business conditions of transportation.

According to the announcement, 384/570 business conditions in the transportation sector will be reduced or simplified, of which 68.5% of road business conditions will be cut; 67.34% in inland waterway sector, 74.36% in civil aviation sector; etc.

In the taxi transport business, regulations that taxi cars must be equipped with taximeter; the contact telephone number of the taxi agency must be painted on taxi cars; enterprises providing taxi service must have the prescribed minimum number of cars, taxi dispatch center, communication radio frequency, have communication equipment between their center and cars; etc. are cancelled.

In the road transport business, the conditions that vehicles must ensure technical safety and environmental protection; vehicles must be equipped with a tracking device; enterprise must have parking places suitable to the business plan; service staff must be trained professionally; etc. are removed.

In the passenger transport business on a fixed route, the regulations that as from 1 July 2016, enterprises and business cooperatives for passenger transport on fixed routes of 300 km or more must have a minimum number of vehicles as prescribed, etc. are cancelled.

This Decision shall take effect on 17 April 2018.

8.Violation in fertilizer business will be fined up to VND 200 million

On 16 April 2018, the Government issued Decree No. 55/2018/ND-CP, on sanctioning administrative violations in the fertilizer sector. Accordingly, the maximum penalties for an administrative violation in the fertilizer sector is VND 100 million for individuals and VND 200 million for organizations. In particular:

Keeping or storing fertilizers in the same place or together with other commodities such as foods and beverages, animal feeds, human and veterinary medicines will be fined from VND 1 million to VND 2 million. A fine up VND 50 million shall be imposed on trading fertilizers, which have been expired for a batch of fertilizer worth less than VND 70 million.

Violations such as, the person as direct manager of production of fertilizers does not have at least a Bachelor degree in such majors as horticulture, plant protection, etc.; trading of fertilizers containing limiting nutrients in excess of the permitted maximum limit; etc. shall be imposed a monetary fine varying from VND10 million to VND 15 million for each violation.

The statute of limitations for sanctioning administrative violations in the fertilizer sector is 1 year; except for administrative violations in manufacturing, trading, importing and exporting fertilizers, it will be 2 years.

This Decree shall take effect on 16 April 2018; with the exception of Article 7.4, which shall take effect on 20 September 2020 for organizations and individuals have been trader in fertilizers before 20 September 2017.

9. Instructions for registration of color photocopiers

On 11 April 2018, the Ministry of Information and Communications issued Decision No. 529/QD-BTTTT, announcing amended, supplemented or cancelled administrative procedures in the field of publication, printing and distribution under the authority of Ministry of Information and Communications.

One of the revised procedures announced in this Decision is the registration for use of color photocopiers and printers with function of color photocopying.

Particularly, prior to using color photocopiers and printers with function of color photocopying, organizations and individuals must submit application dossiers to the local Department of Information and Communications.

Within 5 working days since the date of receipt of complete dossiers, the local Department of Information and Communications shall certify the registration in writing; In case of non-certification, a written reply clearly stating the reasons is required. A dossier of registration for use of color photocopy machine or printer with color photocopy function includes:

(a) Application for use of color photocopier or printer with function of color photocopying;

(b) A copy with the original for counter-check or a certified copy (if sent by post or delivery service) of the permit for import of the machines issued by the Authority of Publication, Printing and Distribution; machine purchase or rental contracts and invoices;

(c) Application for transfer (for machines which have been registered for use) with certification of the local Department of Information and Communications where the machine was registered.

This Decision shall take effect on 1 May 2018.

10.Commodities Exchange Agencies must have the charter capital of at least VND 150 million

Some provisions of Decree No. 158/2006/ND-CP dated 28 December 2006, detailing the Commercial Law with respect to trading goods through Commodities Exchange Agencies have been amended and supplemented by Decree No. 51/2018/ND-CP dated 9 April 2018.

Accordingly, Commodity Exchange Agencies are qualified to establish if: having the charter capital of at least VND 150 million; having an information technology system that meets requirements for technological and technical solutions in activities of trading commodities through Commodity Exchange

Agencies such as a system of software having log functions to track all transactions of trading, payment and delivery for a period of at least 5 years, etc.

Foreign investors are allowed to contribute capital to establishment of a Commodity Exchange Agency in Vietnam; purchase shares or capital contribution portion in a Commodity Exchange Agency in Vietnam on the conditions at no more than 49% of the charter capital.

Broker of the Commodity Exchange Agency must have the charter capital of at least VND 5 billion. A trader of the Commodity Exchange Agency must have the charter capital of at least VND 75 billion.

This Decree shall take effect on 1 June 2018.

11. 28 procedures on food and nutrition safety are cancelled

On 6 April 2018, the Ministry of Health issued Decision No. 2318/QD-BYT, promulgating newly-issued or cancelled administrative procedures in the field of food and nutrition safety under its authority.

Accordingly, there are 28 cancelled administrative procedures on food and nutrition safety, including:

(a) Grant of a Certificate confirming contents of an advertisement for dairy and nutritional products for children;

(b) Grant of a Certificate confirming contents of an advertisement for dietary supplement, micronutrient forty foods;

(c) Re-grant of a receipt of declaration of technical regulation compliance and a certificate of conformity with regulations on food safety within the authority of the Ministry of Health;

(d) Re-grant of a Certificate confirming contents of an advertisement through conferences, meetings, or introduction events of foods and food additives in the case where the certificate is lost or damaged, etc.

Additionally, the Ministry of Health promulgated 10 newly-issued administrative procedures within its authority, including: Confirmation of contents of an advertisement for health supplement food; Confirmation of contents of an advertisement for medical nutrition products, products for special diet, nutritional products for children less than 36 months old; etc.

This Decision was issued and took effect on the same date 6 April 2018.

12. New guideline for identification of origin of goods

On 3 April 2018, the Ministry of Industry and Trade issued Circular No.05/2018/TT-BCT, on origin of goods (“Circular 05”).

Accordingly, the general principle to identify the origin of goods is that the good is originated from a country, group of countries, or territory where the last processing stage is performed which makes fundamental changes to the goods.

In particular, the identification of origin of goods will be based on the rules of preferential goods origin and non-preferential goods origin as specified in Articles 5 and 6 of this Circular.

Besides, the traders who apply for grant of a Certificate of Origin shall make a declaration or commitment that the origins of exported goods satisfy the rules of the preferential goods origin or the non-preferential goods origin in accordance with the prescribed forms in Appendices II, III, IV, V, VI, VII, VIII and IX of this Circular.

In the case where the trader who applies for grant of a Certificate of Origin is not the manufacturer, it must request the manufacturer to make a declaration or commitment in accordance with the above-mentioned forms. Circular 05 took effect on the date of issuance.
