Obtaining a certified copy of the Certificate of Copyright Registration in Myanmar: How?
The Certificate of Copyright Registration in Myanmar is the official record that your work is protected under Myanmar’s Copyright Law. It serves as prima facie evidence of copyright ownership and the date of creation, crucial for enforcing copyright, licensing, transferring rights, and possibly in court proceedings related to copyright disputes. But what happens when this critical document is lost or damaged?
As per Article 51 of Myanmar’s Copyright Law, it is possible to obtain a certified copy of the Certificate of Copyright Registration should the original certificate become lost or damaged.
1. Steps to obtain a certified copy of Copyright Registration Certificate in Myanmar
• Application to the Registrar: You need to apply to the Registrar for a certified copy of the Certificate of Copyright Registration. This application process requires you to provide details of the original registration, such as the copyright registration number, the name of the copyright owner, and possibly details regarding the loss or damage of the original certificate.
• Prescribed fees: The law mentions subscribing to the prescribed fees, which implies there is a set fee for obtaining a certified copy. While the exact amount isn’t specified in Article 51, fees for such services typically cover the administrative costs associated with processing your request and issuing the certified copy.
• Registrar’s verification process: Upon receiving your application and fee, the Registrar will verify your request. This step ensures that you are the rightful copyright owner and assesses the validity of your claim regarding the loss or damage of the original certificate.
• Issuance of the certified copy: Upon verifying the information and receiving the prescribed fee, the Registrar will issue the certified copy of the Certificate of Copyright Registration. This certified copy will serve as a legally valid replacement for the original certificate, holding the same evidentiary value in proving copyright ownership and registration details.
