Market Surveillance Agency officially becomes the General Department
VCN – The General Department of Market Surveillance is an organization directly under the Ministry of Industry and Trade, which acts as an advisory body to assist the Minister of Industry and Trade in managing the state and organizing the enforcement of the law on prevention, combat and handling of acts of smuggling, production and trafficking of fake and banned goods or goods with unknown origin; and act of infringement of intellectual property rights, ect.
The Prime Minister has issued Decision 34/2018 / QD-TTg regulating the functions, tasks, powers and organizational structure of the General Department of Market Surveillance under the Ministry of Industry and Trade.
Accordingly, the General Department of Market Surveillance shall be responsible for submitting to the Minister of Industry and Trade for submission to the Government and the Prime Minister for consideration and approval of the draft laws and draft resolutions of the National Assembly, draft ordinances and resolutions of the National Assembly Standing Committee; draft resolutions and decrees of the Government; draft decisions and directives of the Prime Minister on the organization and operation of the market surveillance force; the regime and policies for the market surveillance officers; strategy, national target program, action plan, long-term development plan, important schemes and projects, and draft reports on organization and operation of the market surveillance force.
The General Department of Market Surveillance has functions of organizing the performance of specialized inspection and examination tasks and handling administrative violations according to the law; directing, guiding and carrying out specialized inspection and examination activities, and combating law-breaking acts within its scope of functions, tasks and powers; taking professional measures to conduct specialized inspection and examination and handle administrative violations; collecting documents, evidence, samples of goods, material evidences and means with signs of violation; verifying samples as goods, documents, papers, evidences related to law violations of individuals and organizations, and handling administrative violations.
At the same time, conducting internal inspections and dealing with complaints and denunciations; handling under its competence or proposing to competent authorities for handling unlawful acts related to the market surveillance force according to law provisions; preventing and combating corruption and negative acts and practicing thrift and combating wastefulness in the use of allocated assets and funds according to the provisions of law. Organizing the propagation, dissemination and education of laws on fields under its management.
Besides collecting information, analysing, evaluating and forecasting the situation to advise and propose to competent authorities for applying measures to prevent and fight against unlawful acts; building, operating and developing an information system and databases on geographical management, results of specialized inspections and examinations, handling of administrative violations and databases on management of human resource and assets, and other databases to support operations of the market surveillance force under the assignment by the Minister and the law; synthesizing and reporting on the results of specialized inspections and handling the administrative violations committed by the market surveillance force to the competent level.
Regarding the organizational structure, the market surveillance organizations at the central level include: the General Department Office; Department of Personnel and Organization; Department of General Affairs – Planning – Finance; Department of Policy – Legislation; Department of Inspection; Department of Market Management.
The provincial-level Market Surveillance Department under the General Department includes: The Market Surveillance Department of the province or city directly under the Central Government; Inter-provincial and municipal Market Surveillance offices under the Central Government.
The district-level market surveillance Division under the provincial-level Market Surveillance Department shall include: Market Surveillance Divisions of towns, districts, cities and provinces under the Central Government; Inter-district, town, cities in provinces and cities under the Central Government; Specialized market surveillance divisions and Outside Market Surveillance Division.
Provincial-level Market Surveillance Department and district-level market Surveillance Division have their own legal status and own seals and are permitted to open accounts at the State Treasury according to the provisions of law.
The General Department of Market Surveillance has one Director General and no more than 4 Deputy General Directors. The Director and Deputy Directors are appointed, or dismissed by the Minister of Industry and Trade according to the provisions of law.
This Decision takes effect on 12th October 2018 and replaces the Prime Minister’s Decision No. 19/2009 / QD-TTg dated 6th February 2009, defining the functions, tasks and powers, and the organizational structure of the Market Surveillance Department under the Ministry of Industry and Trade.
